Atty. James Beirne Made Duldulao Homeless


Lawsuit alleges Filipinos lost house because James Beirne's law office failed to file bankruptcy petition. A Los Angeles Superior Court lawsuit filed in June 2011 alleges that Plaintiff DiosDado Duldulao retained Attorney James Beirne in November 2008 for a Chapter 13 bankruptcy petition; that in January 2009 James Beirne sent a prepared bankruptcy petition to Duldulao to sign, which he did, along with a law firm prepared authorization instructing Beirne to immediately file the bankruptcy petition.

However, the bankruptcy petition was never filed and the Duldulao family lost their home to foreclosure. Attorney James Beirne never met with or personally communicated with the Duldulaos, the lawsuit alleges. It also states that James Beirne admits all communications were through a ‘consultant’ Ruby Sexton who advised the bankruptcy petition was filed, even after the Duldulaos presented a Notice of Trustee Sale to Ms. Sexton.

The lawsuit also alleges that Ruby Sexton told the Duldulaos to stop paying their mortgage, and for Ms. Duldulao to stop working at her second job. Prior to receiving this advise the Duldulaos always paid their mortgage on time.

The lawsuit discusses a pattern of abuses by Attorney James Beirne, including false advertising. The lawsuit states that Beirne advertising stated that “all services are supervised by an attorney” but that there was only one attorney, James Beirne, handling over 900 active cases at one time. The case file indicates, the lawsuit alleges, that there was only one document indicating Attorney Beirne’s personal involvement.

No wonder the Duldulaos case file got lost at the James Beirne's office. Sadly, they also lost their home to foreclosure.
